Welcome to HatidKitaPH! These Terms and Conditions ("Terms") govern your access to and use of the HatidKitaPH App ("App"), a mobile platform that enables ride booking (via tricycles, motorcycles, etc.) and parcel delivery services. By accessing or using the App as either a customer or driver, you agree to be legally bound by these Terms. If you do not agree, please do not use the App.
Effective Date: June 01, 2025
1. Acceptance of Terms
By creating
an account or using HatidKitaPH, you acknowledge and agree to comply with these
Terms and our Privacy Policy. HatidKitaPH reserves the right to modify or
update these Terms at any time. Continued use of the App after changes have
been posted signifies acceptance of those changes.
2. Eligibility
Customers: Must be at least 18 years old or have guardian
consent to use the App.
Drivers: Must be at least 18 years old, possess a valid
driver's license, and comply with all applicable local laws, including vehicle
registration, insurance, and TODA (Tricycle Operators and Drivers Association)
or barangay authorization where applicable.
3. Account Registration
Customers must register with accurate, complete personal and
contact information.
Drivers must submit valid credentials, including proof of
identity, license, vehicle documents, and other required registrations. Users
are responsible for maintaining the security of their account.

7. Payment and Fees
Customers: Fees for rides and deliveries are shown in the App
and may include base fare, per-kilometer charges, and additional handling fees
(for fragile or oversized parcels). Payments are processed via the App or Cash
payment.
Drivers: Earnings are disbursed through the App, less
applicable service fees. HatidKitaPH may charge a platform commission.
8. Cancellation and Refund

Cancellations: If
cancelled after a driver has been dispatched, a fee of 10% of the estimated
fare or a minimum of ₱30, whichever is higher, may be charged.
Driver
Cancellations: Repeated
or unjustified cancellations may lead to penalties or account suspension.
Refunds: Requests for refunds must be submitted via the
App. Refunds are subject to review.

to indemnify and hold HatidKitaPH and its affiliates harmless from claims or
damages arising from violation of these Terms, misuse of the App, or unlawful

reserves the right to suspend or terminate any account for violations of these
Terms, fraudulent activities, or threats to the safety of the community.
13. Dispute Resolution
Disputes
shall first be addressed through the App’s support team. If unresolved, they
shall be subject to binding arbitration in the Philippines, in
accordance with the Philippine Dispute Resolution Center rules.
14. Governing Law
These Terms
are governed by the laws of the Republic of the Philippines. Legal
actions must be filed within Philippine jurisdiction.
